Terms and Conditions<\/strong>
for digital online courses and the sale of physical goods<\/p>

1. Scope<\/strong><\/p>

These Terms and Conditions apply to contracts concluded by consumers or businesses through the stiLRetro website with the Provider for digital online courses, accompanying digital materials and physical goods.<\/p>

A consumer is a natural person entering into a legal transaction predominantly for purposes that are outside that person’s trade, business or independent professional activity.<\/p>

2. Conclusion of the contract<\/strong><\/p>

The presentation of courses and goods on the website does not itself constitute a binding offer. By completing the ordering process, the customer submits a binding order. The contract is concluded when stiLRetro expressly accepts the order or provides the digital product or dispatches the goods.<\/p>

Before the order is submitted, the customer is shown the essential characteristics of the product or service, the total price, any additional costs, available payment methods and any delivery restrictions.<\/p>

3. Prices and payment<\/strong><\/p>

The prices displayed on the website at the time of the order apply. Where required by law, displayed prices include applicable taxes. Shipping charges and any other additional costs are shown separately before the order is completed.<\/p>

Available payment methods are displayed during checkout. Unless otherwise stated during checkout, payment is due upon conclusion of the contract.<\/p>

4. Online courses and digital content<\/strong><\/p>

Online courses may include video lessons, texts, recipes, PDF files, images and other accompanying digital materials.<\/p>

After conclusion of the contract and successful payment, the customer receives access to the purchased course. Access is provided for six months from the date on which course access is made available, unless the relevant offer expressly states otherwise.<\/p>

The customer is responsible for having a suitable internet connection, device and the usual technical requirements needed to use the course. Any special technical requirements will be communicated before the contract is concluded where necessary.<\/p>

4a. stiLRetro Club (subscription)<\/strong><\/p>

The stiLRetro Club is a paid subscription that gives access to the closed Club materials for as long as the subscription is active. It is offered for one month (EUR 30) or one year (EUR 150); the price displayed on the website at the time of the order applies.<\/p>

The Club subscription does not include access to individual paid online courses. Such courses are purchased separately.<\/p>

The subscription renews automatically for the same period (month or year) until it is cancelled. Payment for each following period is charged to the payment method selected at checkout.<\/p>

The subscription can be cancelled at any time in the customer account (“Account” \u2192 “Club subscription”). A cancelled subscription does not renew; access to the Club materials remains available until the end of the period already paid for. Statutory rights of termination remain unaffected.<\/p>

If a payment fails, access to the Club materials may be suspended until payment is made.<\/p>

Section 10 on digital content and the right of withdrawal also applies to the subscription.<\/p>

5. Rights to use course content<\/strong><\/p>

Course content and accompanying materials are protected by copyright. For the agreed access period, the customer receives a simple, non-transferable right to use the provided content for personal purposes only.<\/p>

Sharing login credentials, publishing, copying, distributing, reselling or otherwise making course content available to third parties without the express consent of stiLRetro is prohibited. Any uses mandatorily permitted by law remain unaffected.<\/p>

6. Provision and availability of digital content<\/strong><\/p>

stiLRetro provides digital content in accordance with the relevant product description. Temporary interruptions that are technically necessary, including maintenance or security measures, may occur. The customer’s statutory rights in the event of non-conforming provision or defects in digital products remain unaffected.<\/p>

7. Physical goods, delivery and shipping<\/strong><\/p>

For physical goods, the delivery areas, delivery times and shipping costs stated in the relevant offer apply. Where no specific delivery date has been agreed, delivery will take place in accordance with applicable statutory requirements.<\/p>

For consumers, the risk of accidental loss of or damage to the goods generally passes only when the goods are handed over to the consumer or to a third party designated by the consumer, unless mandatory law provides otherwise.<\/p>

8. Retention of title<\/strong><\/p>

Delivered goods remain the property of stiLRetro until payment has been made in full.<\/p>

9. Statutory rights in case of defects<\/strong><\/p>

Statutory rights relating to defects apply to digital products and physical goods. Nothing in these Terms and Conditions limits mandatory consumer rights.<\/p>

10. Right of withdrawal<\/strong><\/p>

Consumers generally have a statutory right of withdrawal in distance contracts. Details are provided in the separate withdrawal information made available to the customer before the contract is concluded.<\/p>

For paid digital content not supplied on a tangible medium, the right of withdrawal may expire where the statutory requirements are met: the customer expressly consents to performance beginning before the withdrawal period has expired, acknowledges that this causes the loss of the right of withdrawal once performance begins, and receives the contract confirmation required by law.<\/p>

11. Liability<\/strong><\/p>

stiLRetro is liable without limitation for intent and gross negligence and for damage arising from injury to life, body or health. In cases of slight negligence involving an essential contractual obligation, liability is limited to the foreseeable loss typical for the contract. Mandatory statutory liability provisions remain unaffected.<\/p>

Course content is intended to provide knowledge and experience in baking and food preparation. Individual results may vary, including because of ingredients, equipment, environmental conditions and the customer’s own execution.<\/p>

12. Applicable law<\/strong><\/p>

German law applies. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence.<\/p>

13. Contract language and language versions<\/strong><\/p>

These Terms and Conditions are provided in Russian and English. For an individual contract, the language of the checkout process and the contractual information provided to the customer before conclusion of the contract are relevant. Mandatory consumer rights remain unaffected.<\/p>

14. Final provisions<\/strong><\/p>

If any provision of these Terms and Conditions is or becomes invalid, the remaining provisions remain unaffected. The applicable statutory rules shall apply in place of any invalid provision.<\/p>
